I broke the lease because the unit was inhabitable; infested with mold and terrible water damage. I was supposed to be out by 8/11. On 8/08, someone slipped small claims court papers under the doorway without speaking with anyone in the apartment. The landlord claimed that I owed $3500 in for damage to the apartment.
Unfortunately, I was due to be on an airplane that day; I was moving across the country to MA and could not answer the complaint. The court date is supposedly next month and I am unsure of what I can do.
I have pictures of the apartment upon my exit; my original statement of damages which detailed all of the unit’s damages; all correspondence with the landlord, including a letter in which he indicated that he had not been in the unit since my tenancy began (yet he claimed thousands in damages to the unit before I gave up possession).
I know that I have a strong case to defend myself. Unfortunately, I am a student with little income, and I really cannot afford to fly back to CA and answer the complaint, let alone file suit against this slumlord.
If I were to let the judgment go to default (I assume this will happen if I do not attend the hearing), what is his recourse against me? I am mainly worried about my bank account being garnished.
Does anyone know anything about bank garnishment laws? Especially regarding out-of-state judgments (CA judgment, MA is where my bank account is and where I reside). My checks to him were drawn on this same account…I have read that collectors need to find banking information, so it seems he would already have it. Can he just garnish my account right away? Would it do anything to move my funds into another account?
Most of my money is from student loans. However, I have had money transferred into my checking account twice since my student loan deposit from my mother for my rent checks, so the money hasn’t been kept separate. I don’t really know where the money stands as far as being “exempt” or “non-exempt.”
Anyway, I would appreciate any answers, especially regarding bank account garnishment. Thanks in advance…
Call the court in CA where you are supposed to appear and explain the situation. Make copies of all your paperwork and fax it to them. Request that the venue be changed to you current location (this probably won’t work, but its worth it to ask).
Find a free consultation with an attorney in your area and ask questions. The advice is free, after all. Plus, there are tons of “Ask a lawyer” websites you can find, but do something. If a judgement hits your credit it will remain there for a very long time and completely KILL your score. Yes, they will find your bank accounts and garnish them. Fight this any way you can.

(Out of the corner of my eye, I saw a couple of people run onto the plane and into the empty row behind coach.)
Nick- I cant let you! What about your parents? And your family in general?! Dont you think theyll notice and be mad and when youre not home?!
Sofia- I dont care! Ill tell them the truth—that Im in love with you and Im not leaving your side! Im not leaving no matter what! Dont you want to be with me?
Nick- Well, of course I do but—
Sofia- Shhh (she brought her lips to mine and whispered) No buts. I love you more than Ill miss my family.

Well if you can’t attend the hearing, you should be able to participate in it by telephone. Notify the Court you cannot physically be there and request to appear by telephone. An alternative would be to see if the paperwork allows you to respond in writing.
If a judgement against you is awarded by the court, it measn you owe that money. Information that was legally obtained, such as personal information your landlord probably has, can be used to track you down and to track down the bank account.
It might be a good idea to switch banks and open a new account. Keep your old one open too. Move most of your money to the new account.
I think that before garnishment can take place that you have a right to a hearing where you declare your income and expenses. They can onlt garnish part of what’s left. So if you can convince the Court that you only have $5. per month to pay, then that is what you would pay.
The important thing is to not just ignore all of this and then suddenly have a chunk of money taken from your income or balance.

Norad the United States air defence was on a drill on 911 setting the stage
for the greatest public deception ever seen in modern history.
July 24th, 2001. Larry A. Silverstein,
who already owned World Trade Center 7, signs a 3.2 billion dollar,
99-year lease on the entire World Trade Center complex,
six weeks before 9-11.
Included in the lease is a 3.5 billion dollar
insurance policy specifically covering acts of terrorism.
On 911 Planes hit buildings 1 and 2 but no plane hit building 7 which collapsed
8 hrs after the twin towers. Building 7 was also a steel structure building
with impressive welds and bolts holding together it’s very stong fire proof
steel frame.
Sturctural experts and engineers have claimed that steel structure buildings
don’t collapse from fires so some type of explosive would have to be
used such as therminite to make such a building fall.
Today August 21, 2008 on assosiated press airs a report by Federal investigators
that there is no proof of explosives in wtc 7 and fires caused the steel stucture building to collapse
making it only the 3rd steel structure building of it’s kind in history to collapse from
fire behind towers 1 & 2.
In assosiated presses video discription it exlaims the report debunks conpiracy theorist.
wtc7 Consider the facts:
* The fires in WTC 7 were not evenly distributed, so a perfect collapse was impossible.
* Explosions occurred in WTC 7 before it sustained any damage from the twin towers’ collapses.
* Silverstein said to the fire department commander “the smartest thing to do is pull it.”
* Firefighters withdrawing from the area stated the building was going to “blow up” and
to run the building is going to explode.
* The building subsequently collapsed perfectly into its footprint.
* Molten steel and partially evaporated steel members were found in the debris of wtc7
After the initial blast [Flight 11 hitting WTC 1],
Housing Authority worker Barry Jennings, 46,
reported to a command center on the 23rd floor of 7 World Trade Center.
He was with Michael Hess, the city’s corporation counsel,
when they felt and heard another explosion. First calling for help,
they scrambled downstairs to the lobby, or what was left of it.
“I looked around, the lobby was gone. It looked like hell,”

My theory is all the building were rigged for detonation prior to 911
but there was a missing plane that did not hit wtc7 but the detonators
went off anyway. Jets can not knock down steel structures but to the
untrained public eye this was a good reason for war do to terrorist attacts.
Naturally an accident can not be investigated when it’s done by the intelligence
agencies themself and all the evidence removed and accounted for.
World trade center 7 is at the top of this diagram. It is seperated
from the twin towers by buildings 6 and 5.
